Commissioner Pat Lundvall announced at the beginning of the call that the disciplinary hearing of Silva needed to be tabled due to Silva’s attorney, Ross Goodman filing a motion to have the hearing dismissed.

“Mr. Silva has filed a motion to dismiss that particular disciplinary matter and until resolution from that procedural motion is resolved, we can not move forward with the disciplinary complaint,” Lundvall said.

Prior to today, Silva was expected to appear in front of the commission concerning a drug test that was ordered by the commission in June. However, Silva did not take the drug test and admitted to the commission in June that he took diuretics before the test was required due to an injury he suffered earlier in the year.

Following the announcement that the disciplinary hearing was tabled, details came out on the motion that Goodman has filed to get this issue dismissed. According to MMAFighting.com, Goodman believes the commission lacks jurisdiction to take action against his client since he did not have a license when the drug test was ordered.
