The XFC recently stated that Kalindra Faria is under an exclusive contract with the promotion and she should not be allowed to fight at WSOF 15 against strawweight champion Jessica Aguilar.
On Friday afternoon, the XFC released a statement on their intentions to file a suit against the WSOF for booking Faria.
“XFC has an exclusive contract with Ms. Kalindra Faria, which XFC provided to WSOF,” XFC President Myron Molotky said. “Not withstanding the clear terms of Ms. Faria’s exclusive contract with XFC, WSOF has made it clear it intends to proceed with Ms. Faria’s bout planned for this weekend.”
“There is no question that XFC has a valid contract with Ms. Faria and that her fighting in a WSOF match this weekend violates XFC’s rights under that contract. As a consequence of WSOF’s actions, XFC is filing suit against WSOF today in the United States District Court in Tampa. XFC is seeking to enforce its rights to the fullest extent of the law.”
Following the XFC statement, WSOF officials received legal documents on this matter prior to the official WSOF 15 Weigh-Ins at the Clarion Hotel in Tampa, Florida. The legal document received by the promotion was a complaint and the WSOF will have 21 days to respond.
The XFC maintains that Faria signed a contract with the promotion in August. However, Faria has signed an affidavit that she did not sign a new contract with the XFC in August.
Faria made weight for her fight against Aguilar and the fight will take place tomorrow night at the USF Sun Dome in Tampa as part of the WSOF 15 main card on NBCSN according to WSOF officials.
UPDATE: On early Saturday afternoon, Molotky sent a new statement to TheMMAReport.com and explained why his promotion did not file legal documents in a Florida court until yesterday.
“The process to correct this situation began over six weeks ago,”Molotky said in a statement. “Conversation, as well as providing the exclusive contract, photos of the signing, and acknowledgement from the Faria management team about the contract was ongoing until court documents were served. All was handled in a professional and timely manner.”
“The XFC legal team responded with the lawsuit to protect our interest after realizing that WSOF had no intentions to honor or respect the exclusive contract signed in August by Kalindra Faria.”
